Terms of Service
Welcome to Fireside 610. These Terms of Service ("Terms") govern your use of fireside610.com (the "Site") and your participation in any event, gathering, program, or community organized by Fireside 610 ("Fireside," "we," "us," or "our"). By using the Site, registering for an event, or otherwise engaging with Fireside, you agree to be bound by these Terms.
1. Eligibility
Fireside events involve the supervised use of firearms, live ammunition, and prolonged physical activity in outdoor conditions. You may register for and attend a Fireside event only if:
- You are at least eighteen (18) years of age.
- You are legally permitted to possess and handle firearms under federal, state, and local law.
- You are not under the influence of any substance that would impair your judgment or your ability to safely handle firearms.
- You are in sufficient physical and mental health to participate safely.
- You agree to follow all safety instructions, range commands, and venue rules at all times.
2. Account and Registration
When you register for an event, you agree to provide accurate, current, and complete information. You are responsible for keeping that information up to date and for the accuracy of any information provided about guests you register on someone else's behalf. You agree not to misrepresent your identity, age, or eligibility.
3. Event Participation
Participation in any Fireside event is voluntary and at your own risk. You will be required to sign a separate Liability Release and Waiver before participating. By registering, you agree that you will sign and abide by that waiver. Failure or refusal to sign the waiver, or any breach of safety or conduct standards, may result in your removal from the event without refund.
4. Payment and Pricing
- Event prices are listed at the time of registration and are payable in full upon registration.
- Payments are processed by a third-party payment processor (Stripe). Fireside does not store full payment card details.
- All fees are stated in United States Dollars (USD).
- You authorize Fireside or its processors to charge the payment method you provide for the total amount of your registration.
- Refunds, credits, transfers, and cancellations are governed by our Refund Policy.
5. Code of Conduct
Fireside is a faith-grounded brotherhood. We require every participant to uphold the following standards:
- Safety First: Follow every range command, safety brief, and instructor direction immediately and without question. Treat every firearm as loaded.
- Respect: Treat fellow participants, instructors, volunteers, venue staff, and guests with respect. Harassment, threats, slurs, and discriminatory behavior based on race, ethnicity, religion, national origin, disability, or sexual orientation will not be tolerated.
- Sobriety: No alcohol, recreational drugs, or impairing substances at any time during a Fireside event. Prescription medications are permitted if they do not impair your ability to safely participate.
- Integrity: Be honest about your skill level, your equipment, and your physical readiness. Do not bring firearms or ammunition that have not been disclosed in advance.
- Confidentiality: What is shared in brotherhood circles stays in brotherhood circles. Do not record, photograph, or publish what other men share without their permission.
Violation of this Code of Conduct is grounds for immediate removal from the event, removal from future events, and termination of your participation in the Fireside community, all without refund.
6. Intellectual Property
The Site, including all text, graphics, logos, photographs, video, software, and other content, is the property of Fireside 610 or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, publish, modify, or create derivative works from any part of the Site without our prior written permission, except for personal, non-commercial use.
7. User Content
If you submit testimonials, photos, videos, comments, or other content to us, you grant Fireside a non-exclusive, perpetual, royalty-free, worldwide license to use, reproduce, modify, display, and distribute that content for any lawful Fireside purpose. You represent that you own or have all necessary rights to the content you submit and that it does not infringe any third-party rights.
8. Disclaimers
THE SITE AND ALL CONTENT, EVENTS, PROGRAMS, AND COMMUNICATIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FIRESIDE 610, ITS OFFICERS, DIRECTORS, MEMBERS, VOLUNTEERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PARTICIPATION IN ANY EVENT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY EVENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED UNITED STATES DOLLARS (USD $100), WHICHEVER IS GREATER.
These limitations apply regardless of the legal theory on which any claim is based, including contract, tort (including negligence), strict liability, or any other theory. Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent any limitation in this section is unenforceable in your jurisdiction, our liability shall be limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Fireside, its officers, directors, members, volunteers, employees, agents, and licensors from any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Site or participation in any event, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) any content you submit.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms, the Site, or any Fireside event shall be brought exclusively in the state or federal courts located in Okeechobee County or Palm Beach County, Florida, and you consent to the personal jurisdiction of such courts.
12. Termination
We may suspend or terminate your access to the Site, your registration in any event, or your participation in the Fireside community at any time, with or without notice, for any reason, including violation of these Terms or our Code of Conduct.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you by email or through the Site. Continued use of the Site or participation in any event after changes means you accept the updated Terms.
14. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, Refund Policy, Cookie Policy, and any event-specific waiver, constitute the entire agreement between you and Fireside regarding their subject matter and supersede all prior agreements.
